Q) Law and ethics are considered to be the two tools for controlling human conduct so as to make it conducive to civilised social existence (a) Discuss How they achieve this objective (b) Giving Example show How the two differs in their approaches.
Ans : Law try to achieve the goal of the civilised social existence by (a) Treating ceratin acts illegal. Illegal acts are punished by the Judiciary. (b) In this way it also brinngs deterrance to some acts which can disturb the peace and harmony of Harmonised society ex UAPA( Unlawful activities prevention acts) (c) There ar various enabling legislation for the weaker section of the society like Reservation for SC/ST/OBC and Anti Dowry Act etc (d) Law aims to protect individual fundamental rights like freedom,euality etc. At the same Time Social Harmony is ensured by Laws through specific legislation ex 153 A of IPC (e) Machinary like direct periodic election to legislature, Judicial Review , Constitutional Amendment , Appealte mechanism in Judiciary , Rule of Law aims to reform Law to achieve the objective of the progressive society.
Ethics try to achieve the objetive of civilised society by (a) Helping Individual to make right decision. (b) Enculcating a Norm and Value of Moral Conducts in the society. (c) Enriching Culture (d) Helping in reforming and Enacting progressive legislations (e) Helping in adminsitrative reform etc Let us take the example of the problem of child labour in India. We have Child Labour Prohibition act in this connection. But it is very poorly implemented. This act have enough deterrence but poor socio-cultural sanction for this led to the poor implementation. Ethics can provide rational and emotional resolution for the child labour abolition. It can also bring in supporting socio-cultural change. Which can alone led to the abolition of child labour in India and world. In this way we see that law without supporting ethical society and culture leds to poor implementation. If a synthesis between the two is done we can expect transformation of our society.

Certain acts are legal but still debatable when comes to ethical quandary.for e.g abortion,capital punishment,coersion in right to privacy of citizenary. Laws may be unjust or blatantly unethical for e.g provision of sedition section 124 A, rowlatt act violating them may be illegal but not still ethical.

..without Instruments of behaviour regulation existence of civilized society is impossible bcz then what the kautilya calls "MATSYANYAYA -Big fish eating smaller one" and "JUNGLE RAJ - anarchy and chaos" will prevail !)

So both are complementary supplementary. But something may be ethical yet illegal or legal yet unethical. For a good and just society both should go together and synonymous.
