  • Kya din aagaye cs aspirants don't even know what's a constitutional right :D

Except fundamental rights there are not other rights which are constitutional. :joy:

Why are they consitutional, because the enforcement mechanism is clearly mentioned the Constitution.

Rights derive origin from the source of enforcement.

Anything mentioned in Constitution does not become a constitutional right unless it's enforcement is explicitly mentioned in the Constitution.

The provisions of Constitution have to be always enforced through statutes (except FR). All such provisions are legal rights.

    B)
Even SC has to reinterprete the provisions of our constitution at several times. Even for the right to vote, SC has given different judgments in different cases. You are expecting too much from yourself and from aspirants in general.
Sc has always validated the constitutionality of right to vote and right to get elected, SC has never decided on the source of the right to vote or right to get elected.
The fault is not with SC, it has gjven perfect judgments. The fault is with aspirants who misinterpret the content of the judgments B)

SC has given contradictory judgments as well. SC has acknowledged its mistakes in the past and corrected them from time to time. Dig deeper and you will know. Read article 137 as well, you will get a better idea. ;)
