  • You are the Executive Director of a Company which is making a
    name for itself in the market.
    A who is a star performer, is heading the marketing team. In a short period of
    one year, he has helped in doubling the revenues as well as creating a high brand
    equity for the Company so much so that you are thinking of promoting him. However
    you have been receiving information from many corners about his attitude towards
    the female colleagues; particularly his habit of making loose comments on women.

    One day, late in the evening, Mrs. X, who is one of Mr. A's team members, comes to
    you visibly disturbed. She complains against the continued misconduct of Mr. A, who
    has been making undesirable advances towards her .
    She tenders her resignation and leaves your office.

    (a) What are the options available to you?
    (b) Evaluate each of these options and choose the option you would adopt

  • Present case study involves following issues
    1)constitutional obligation(of preserving and respecting dignity of women)
    2)Managerial obligation of securing company’s growth
    3)Preserving the image and reputation of the company
    4)fostering healthy work culture
    5)legal obligation under sexual harassment at workplace act

    Disadvantages

    Option C:Proceed Establishing facts
    Will ask Mr A to stay away from work for period of enquiry
    In case he is found guilty,Company as well as legal action shall follow.
    It shall be emphasized that company needs both professional and ethical competence.
    Will invite Mrs X to reconsider her decision because it was made under emotional turmoil.
    Will follow option c
    Will also strengthen internal safeguards and appoint women officer so that female employees feel welcome
    Will conduct awareness session for employees on sexism
    Henry ford has remarked that a business which only makes money is a poor business.Loss of any productive employee without sound reasons shall be avoided.

    Diversity is essential fact of human existence.It cannot be suppressed or denied. Hence diversity must be accommodated and dialogue is the most civilized way forward.
    Dialogue is most appropriate because it avoids violence.Dialogue is most realistic because it gives everyone a chance of being involved and hence chances of survival multiply.For ex Indian constitution is a product of many ideas of India.Indian constitution survived unlike most others in south Asia precisely because it wasn’t imposed on any one.
    Dialogue is most effective because it calls forth varied opinions and facts.Thus there is an element of balance.
    Nobel Laureate Amartya Sen notes that secret of India’s survival despite such diversity is in strong tradition of public debate and plural intellectual traditions(The argumentative Indian).
    Whenever doors of dialogue have been closed ethnic clashes and insurgency has raised its ugly head.

    Man is a social animal. And in any social interaction, conflicts are bound to occur.
    Power, domination, dialogues are some methods of conflict resolution. But for a civilized society, constructive dialogue is most appropriate.

    At the global level, due to the concept of sovereign countries, only bilateral or multilateral dialogues are effective means of conflict resolution. Use of power & domination has historical consequences in the form of world wars.
    In recent history, Iran & P5 + 1 nuclear deal is testimony of constructive dialogue for conflict resolution. Whereas the syrian crisis is example of the opposite.

    At national level, considering Indian federal structure, forums like inter-state council, zonal council are effective dialogue plateforms. And resort to Art.356 i.e. President's rule often weakens cooperative federalism.

    At local level also, involving communities through dialogue in the decision making results in better policies.

    Therefore, dialogue may seems as a slow process but in the long term it leads to effective results.

    Thanks @tiger101 I am trying to change my writing style so needed a feedback. Now my focus is on simple short sentences and adhering to word limit. And yes answer is written well within 5 mins.

    excellent examples,but i think u can avoid article 356.U can also mention taliban,Naga insurgents,FARC etc., have come to the negotiating table because violence did not gave the expected results for them

    Upholding right to choose, the Supreme Court recently allowed a woman to abort her over 20-week-old foetus with severe abnormalities. In light of this, bring forward the ethical questions of abortion from a standpoint of view of the mother, unborn child, doctor and the state. Should there be termination of pregnancy beyond the permissible limit under MTP Act?

Should there be termination of pregnancy beyond the permissible limit under MTP Act?
    The issue lies at inter junction of human rights,morality and religion.
    Ethical issues
    1)Right to bodily autonomy-of the mother.Hence abortion has been a key issue in feminist debates.
    2)Right to choice-its important given motherhood poses physical psychological and economic responsibilities for the mother
    3)Right to life-of the unborn
    4)religious angle-abortion i.e deliberate end to a life is shunned upon in some religions
    5)Legal angle-given high prevalence of female foeticide it needs to be ensured rights under the act are not abused
    6)Limits of state control-as is obvious this is an intimate matter for the women.limits of state control which don’t hamper liberty of individual are questionable
    7)medical ethics and professionalism as both the woman and courts rely on judgement of the doctors

    As a general rule only abortions within legal limits (20 weeks) should be allowed.Law ,medical profession and Ethics concur here.This is essential for women empowerment as well as avoiding abuse
    However exceptional circumstances demand exceptional actions,as in this case.
    Reasons could be foetal abnormalities or in case of rape victims and delay in approaching courts as had happened in Uttar Pradesh last year.Simply because laws need to be woven around people and not vice versa.
    Establishing motive and absence of mal intentions should be key to deciding if exception can be made.
