Raj Bala judgement does not inspire much confidence and is unsafe to be relied upon. It is a well settled principle in Indian law that right to vote is merely a statutory right while some rights incidental to it have constitutional and fundamental rights protection. It is pertinent here to point out that Raj Bala is only a division bench judgement and does not take into account previous judgements of constitutional benches. Thus reliance should be placed upon Kuldip Nayar vs Union of India and K Krishnamurthy both of which are constitutional bench judgements along with PUCL which held that right to vote is in the nature of a legal right only.
but ncert clearly says right to vote and be elected is a constitutional right..
I feel NCERTs are insufficient to answers such intricate legal issues. I do not know how much detail UPSC has gone into to frame this question. But it is abundantly settled that right to vote and to contest are statutory rights, Raj Bala judgement being only detractor. There are several authoritative judgements on this question all of whom were disregarded by the judges in the present case. But, can a division bench of two over-rule judgements of Constitution Benches and of a 3 judge bench? No. The issue of right to vote and to contest has been settled and was clarified by Kuldeep Nayar (2006), K. Krishnamurthy(2010) and PUCL(2013, which went into a very detailed discussion to clarify any anomaly or confusion). Right to vote and to contest are merely statutory in nature while certain rights entwined with it have constitutional and fundamental right protection.
