Bhai logo jo bhi draft/strategy prepare kar raha hai aur suggestion de raha hai and all who are present in this thread, please do read this May 2013 judgement (I know iam quoting @gks but there are others also for this cause). I have read this (though not perfectly) and there are insights in this about what kind of argument upsc gives to refute whatever changes.
1. UPSC said that arguments of petitioners are based upon 'mere assumptions and presumptions and later also says "are not supported by any facts or figures" . Iska matlab upsc se argument karne ke liyr facts or figures hi chahiye unko warna muh band rakho: bhai ye to galat hai when there are some social realities which are subjective in nature and not realising them just because you favour status quo. Waise hum yaha anti-CSAT junta se ulti ladai lad rahe hai lekin kis terh ke arguments face karne padte hai ye dekhne wali baat hai
2. On page 8 as a counter-argument of upsc " that the Supreme Court in Narmada Bachao Andolan Vs. State of MP (2000) 11 SCC 639 has held that Court cannot strike down a policy decision taken by the Government merely because it feels that another decision would have been fairer or more scientific or logical or wiser. " So while making our argument we will have to say "Gross injustice" done to us by informing us only 3 months prior. Kewal 'unfair decision kehne se kaam nai chalega.
3. UPSC itself says that changes are brought after "in-depth" consideration by a committee and regularly committees are formed to bring reforms in the examination. To sawal uthta hai ke ye just 3 mahine pehle CSAT qualifying only karne ka decision lia ye kis committee ke recommendation par lia. Aur greatness to ye hai ke change pehle lekar aa gaye aur Baswan committee baad me banai gai. Dhanya hai shrimaan. Political pressure ki jai ho.
4. On page 10 " that the UPSC thereafter set up an Expert Committee to decide on the syllabus of both the papers; accordingly the Committee headed by Professor S.K. Khanna, former Vice Chairman, UGC to give specific recommendations on various aspects of the syllabus was constituted; that the Professor S.K. Khanna addressed a letter dated 18th August, 2010 to the Government and the Government in response dated 15.10.2010 (impugned in this petition) conveyed the approval to the changes recommended and on 19th February, 2011 notified the Rules of examination in the Gazette of India Extraordinary by incorporating the said changes; " Kya 2011 ke change 6 mahine pehle hi kie gaye the, agar aisa sahi hai to this is CALLOUSNESS when people prepare for yearsfor this exam. Aur 2015 me just 3 months prior change to EXTREME CALLOUSNESS hai.
5. Last page jaha judge ne ruling di hai " We therefore dispose of this petition by directing the Union of India to, within three months here from, constitute appropriate Committee/Body, if not already in place, for examination of the questions aforesaid raised by the petitioners in this petition and the representations of the petitioners and as highlighted by us in this judgment and to, in consultation with the UPSC, within nine months take a decision on the nature of the test of knowledge of English language in the Civil Services Examination i.e. whether it is to be only qualifying or competitive or mixture of both. We are confident that such Committee, in its report will give reasons for its decision. " Decision lene ke liye bola tha use ekdum se implement karne ke liye nai. Kya 1 saal ka time dekar implement nai kiya ja sakta tha decision. Itni jaldi kya thi ke last moment possible which was ' may 2015 upsc notification ' par bataya gaya ye change. Decision koi inhone may-april me to nai lia hoga balki thoda usse pehle hi to tab nai bata sakte the kya chahe upsc ho ya govt. Aur le bhi lia decision to 2016 se lete. Ye "malafied intent " nai to aur kya hai ke last moment possible pe inhe batao.
