Wo curtailment wala..23.5 page pe likha hai..Laxmikanth 3rd edition...i m telling as per that only...bhai..
Now I can understand why people always say don't read Laxmikanth. Hehe. Read the first line in SC chapter in DD Basu. Anyways one does know right if Parliament amends something it changes. That is the speciality of Parliamentary form of Govt.
@vivekanand Bhai baat tumhari sahi hai...DD Basu me likha hai
" Parliament has the power to make laws regulating the constitution, organisation, jurisdiction and power of the the Supreme Court "
Ok assume it is curtailed...but then also how it can take independence from judiciary untill and unless there is a provision of accountability. Presently there is no accountability so no threat to independence.
Judiciary's independence can be curtailed indirectly by reducing its power. Parliament starts making amendments to the constitution to counter every possible judgment.
By doing this, legislature is not encroaching Judiciary nor is undermining its power, but in a way reducing it by using its own power to circumvent the possible exercise of judiciary's power.
Now, what is the point of having an independence which is worth nothing. it is like being reduced to a Dominion status (indirect inference). Legislature by virtue of its law making ability is curbing your power of exercising your authority.

in short u r talking about accountability :P
Making a law to counter the rule of CIC, or RPA is not equivalent to establishing an organisation to monitor accountability.
Using my own law making to reduce your power is not equivalent to me monitoring you and making you accountable
This is what I wanted to say that....if you decrease power also....then independency is not breached.....
independency is breached is only breached when we are controlled or accountable ....
I think we have a disagreement on this sir, and lets leave it there. Pura question to accha discuss hua. I wait for few more replies,.
