The English East India Company like any other business entity was in continuous look for profits. Profit maximization was possible only in a period of stability and prosperity and the company had to maintain it at any cost. The 18th century was a period of turmoil for the company with stiff competition from the French and the rise of the native rulers against the interests of the company. This naturally led to instability and decay. The competition from the French extended to the Political dimension. With the aggression of Dupleix in India, the English felt that they would be left behind if not for their methods of conquest and subjugation. Subsequently, the strategy also helped them achieve the desired end. The complete defeat of the French company did not solve all the problems of the English company. With the likes of Hyder Ali and Tipu Sultan, the English saw their interests severely threatened. Sensing Tipu’s interests in allying with Napoleon was seen as a great threat to their motives and the English company resorted to war to stabilize its interests. With political instability leading to decay, the General’s of the English company found a way to have the cake and eat it too. They morally justified their conquest and subjugation on the basis that it increased the stability and prevented decay.
The expansion of the powers of the judiciary to a greater extent shall be at the cost of the legislature and the executive. Given the nature of this expansion it shall be at the cost of its Independence as well. With the expansion of the powers of the Judiciary to the other domains, it will be more subjected to interference from the legislature and the executive. The interference may be in the form of curtailing the powers of the Judiciary or trying to influence its members. In case of the latter, it shall be a severe threat to the independence of the Judiciary. A compromised Judiciary is neither independent nor powerful. The way the expansion of power of the Judiciary takes place should also be considered. In case the power expansion occurs due to Judicial activism or overreach, it shall serve as an excuse for the legislature for clipping the wings of the Judiciary. In a Parliamentary form of democracy, with the balance clearly tilted in favour of the Legislature, such an expansion would threaten the Judiciary’s independence. In case the expansion of the Judiciary’s power happens within the limits of its domain, it shall make it not only more independent but more efficient as well. Such an empowered Judiciary with corruption under control and efficient disposal of cases is the need of the day.
@vivekanand Parliament cannot curtail the jurisdiction (power) of Judiciary. I can only expand or maintain status quo.
Another point is expansion of power/jurisdiction is different compared to independence or control.
What Parliament cannot curtail power of Judiciary? Bro, it can amend constitution itself and not all powers of the Judiciary fall under Basic structure. :O
And I don't get what you mean expansion of power is different from independence. I never said its same. I think you've confused yourself by unwantedly equating Jurisdiction and power. Jurisdiction is AREA over which POWER is exercised. It is different from power itself.
