Just sharing pointers from Hindu Article I just read on 295/153, in case any one interested

    http://www.thehindu.com/opinion/op-ed/little-reason-to-restrict-the-freedom-of-speech/article5168476.ece

The amendments carried out in 1972 replaced section 153 of the Indian Penal Code with sections 153 A and 153 B
Sections 153A and 153 B of the IPC penalise “promoting enmity between different groups on ground of religion, race, place of birth, residence, language, etc.,” and committing acts “prejudicial to maintenance of harmony”; and sections 295, 295A and 298 deal exclusively with “religious harmony”.
Based on these provisions Rushdies’ Satanic Verses was banned, M F Hussain was forced to flee from his own country. Besdies these cases there are scores of other cases.
Penguin India said that - Indian Penal Code, and in particular section 295A of that code, will make it increasingly difficult for any Indian publisher to uphold international standards of free expression without deliberately placing itself outside the law.
In order to maintain the spirit of Constitutional Rights Indian Parliament should either repeal or amend the existing IPC sections 153 A and B, and 295-298; or, at least define ‘the frame of applicability’ of the phrases “public order” and “decency and morality” in Article 19 (2) of the Indian Constitution.
