CAPF AC Reserve List

Hi friends,
I want some help and suggestion regarding capf ac exam. I appeared in interview of calf 2016 and lost my rank by 2 marks. That year upsc maintained the reserve list of 42 people out of which they have released the list of 21. List of 21 is yet to be released.

As we all know, many of the people don't join the service or leave it midway in the training. For that purpose, candidates from reserve lost can be called in. (As I think).

I was going through some court cases regarding calf ac recruitment and I come to know about this 2 cases. Both of them are contradictory to each other.

Both cases are based on clause 16.4, 16.5 of recruit notification ehich talks about reserve list and one of the office memorandum of 2000 which says om case of unfulfilled vacancy in the recruitment, ministry should ask commission for recommending names of candidates from reserve list of the year when recruitment drive was held.

As these are legal matter, I'm unable to understand the score and significance of this case with my position.

I'm planning to challenge upsc in delhi hc for release of that reserve list of remaining 21 candidates and to take them into service.

Please help in this regard to understand this cases in a better way. As I'm involved in this case, there are chances of motivated reasoning from my side. That's why I'm asking for your help.

I'm attaching the verdict of both the case here.

One case is of Agam Dayal and another case is of Shashi Kant Singh. Please have a look at them
