In which List do we count- "Environment"?

Can someone pls clarify!
Well I know Forests and Wildlife are in the Concurrent list of 7th schedule but what about 'Environment'!
Is it a Residual subject?

  • Environment as a whole cannot be considered as one subject.

    It involves regulation of forests, construction, water pollution, industrial effluents, carbon tax, nuclear wastage, automobile effluents, international treaties etc. all of which will be spread over the 3 Lists.

    Both the Union and the States have enough subjects in their purview through the regulation of which they can take a pro-environment stance.
  • How do you define environment?

    It has been divided into its constituents.

    Flora + Fauna = Concurrent list.
    Water = State List.
    Land = State List.

    What else?

    If you are looking for environment protection - It will come under concurrent list - Protection of wildlife, Forest.

    + Some subjects are mentioned under the panchayat list - Have to revise! :(

    But you know Why I asked this is. See this:

    "Constitutionally, Environment is a residual subject, with both the Central and the State Government responsible for regulation and enforcement. Thus, there is a need to include ‘environment’ as a concurrent subject in the constitution. This will help the State Governments and the local authorities enact and notify their own enforcement laws and rules to ensure compliance of relevant environmental norms "

    This is from 12th plan vol-1. Looked a bit intriguing to me! :-B

    From the write-up you have posted , it can be clearly seen that 'environment' is currently not considered in the concurrent list.
    'Environment' topic is currently spread over state list , union list and concurrent list.
    If they include it in concurrent list then it would give freedom to local authorities and state legislations to frame/amend laws conveniently and as per their own's conditions.
    This is what I can goad from your write-up.

    On similar line, i have another question in which list do we include disaster management, in second Arc report(2005) it has been mentioned that it is a residual subject, did the subject changed from residual list to concurrent list?
