    Delegated legislation is a necessary evil, comment.
    Ans- Delegated legislature is conferring law/rule making power to executive institutions. Over the time due to steady increase in the complexities of the social, economic and political developments led simultaneous growth of delegated legislation. This enables flexibility to change rules according to the issues that crop up during implementation, tackles emergency situations like terrorist attacks or health related outbreaks, global economic changes etc. Political institution debates on few selective issues and break in sessions also influenced this legislative procedure. Executive orders of USA on border control to lower influx of illegal migrants, Indian raise in foreign investment cap to increase investors are few examples to term necessity of this.

    However, delegated legislation critics termed it as an evil as the implementing institution is determining principles which may give scope for new-despotism. Few instances where judicial institution powers are also lowered given absolute power leading to absolute corruption. Rules, orders may be driven to protect its own interest which may set back public interest and their opinion. Declaring war on a nation, imposing new surcharges on the taxes need political consultation as it effects nation’s economy, popular sovereignty.

    Apparently delegated legislation is desirable with proper vigilance and monitoring tools to multiple stakeholders, this will not only bring good governance but also resolves critical issues.

    Actually I wanted to form a group of people to first plan for studies .. how do you prepare, how to divide work amongst ourselves and then share later, where to dig material from etc.
    I do not intend to meet to discuss questions and answers.
    Will share minutes of the discussion here.
