  • How good is SC verdict on NJAC bill...
    Is SC really acting in interest of nation and protecting the basic features or acting as a monarchial body and want all power in it's hand... :-/
    Thats the best decision this year! NJAC bill wud have proved fatal for india with wrong PM.Moreover it was always unconstitutional, constitution has cleary tried to keep judiciary free from other organs.

    Imagine you are a judge and u think PM ,LAW minister and opposition leader will have greater say in ur promotion and transfer,it ll definitely add fear element.Already judiciary is suffering from corruption.This bill wud have nailed the coffin.
    Actually constitution provided for the appointment of judiciary from the side of executive to keep the check and balance in the system... moreover njac had 3 judges in the committee including chief justice and 2 puisne judges and anytime if 2 or more ppl out of 6 had disagreement, the person in disagreement wouldn't be discussed any further for appointment...
    Exactly the point the, judiciary is already suffering from corruption and shrouding itself with judgement like this will only increase the proportional corruption when no other institution will have any say in the matter...
    No other judiciary make self appointment in the world... and we have seen the inefficiency of the collegium in the past... with more than 30% of seats in high court remained vacant...
    How to tackle this...
    Constitution is silent on jusdiciary appointments but their goal is to keep executive and others in check by judiciary!!!!!
    So u mean appointments made by government or organs runs by them are is not suffering from corruption!!! Hmnnn if u will read katju blog he brought out case how a senior judge was kept despite of corruption charges due to pressure from a TN political party on UPA!! Present CJI has corruption charges in jayalalita case,he also is accused of being baised towards present PM!!

    Corruption in judiciary needs to be taken care by judiciary itself by making an independent body of activists like katju,shashibhushan,prashantbhushan kind of people.Executives should stay off
    Art 124 says this... Every Judge of the Supreme Court shall be appointed by the President by warrant under his hand and seal after consultation with such of the Judges of the Supreme Court and of the High Courts in the States as the President may deem necessary for the purpose and shall hold office until he attains the age of sixty five years.

    Pehle kaise hota tha appointment... SC is to interpret the constitution not ammend the constitution ... it already amended it in 2nd judges case. .... judiciary is not fir this...

    Corruption can't be handeled by judiciary itself... it has failed in tjis attempt we have seen this in last 30 yrs...
    Advice of judges which is binding on president!!! NJAc not only deals with appointment but also promotion and transfers which subjugate judiciary!!
    If u will read emergency saga u ll realise wt happens when judiciary becomes second to executive!! Judiciary has issues but for that independent body can do the job activists name i mentioned have long history of judicial activism,an independent body consisting of such people will work wonders!! They have been exposing corruption in judiciary for long!!!

    Advice of judges was made binding on the president by 2nd judges case... which was not there originally in the constitution, which itself is amendment to the constitution, of which SC has no power... moreover this made judiciary a independent institution which had no link remained to the other institution ie. legislature and executive... thus prone to corruption in judiciary... this also breaks the checks and balances among the 3 institutions which itself is a basic feature of constitution....
    How judiciary will have judicial activism within itself... why will a judge put hands in the collar of other judge... we have seen collegium in last 30 yrs and it has failed in many respect...

    Autonomous body to look after judges will contain whom...it will be judges themselves... moreover if the SC didn't agreed for NJAC, what make you think it will agree for a autonomous body...

    People whose name i mentioned katju,prashantbhushan,shashibushan they have been fighting against corruption in judiciary for decades now. U can check their contribution on internet. Independent body should have such people and can be constituted onmline of lok aayukta but should not have judges but jurists,activists with impeccable record,it will need more thought and can be thought within seconds by a person like me :D Its very much possible to have independent body created by judiciary itself CAG has been created by executive but still report against executive actions!! Katju was judge but pulled allahabad high court for corruption!!

    So there is hope! Anyway i think my opinion may not be enriching from exam point of view.But u must be able to connect dots and see future implications on basis of past!

    bol raha hun abhi nahin pata tujhe... ek din pehle wohi bandi enjoy kar rahi thi wohi sari flirting... jake comments mein dekh pata chal jayega... aur next day ek din pehle ki baat utha k (ek hafte pehle ki bhi) lecture dena shuru... yeh kya hai yaar.... aur suno woh jo line ki ladki ni na mein bhi haan hai.. maine boli thi mazak mein but usee comment mein maine is baat ko reject bhi mara tha.. jake dekh lo... iseeliye bol raha ki tujhe nahin para sari baateinn aur tu judgement pass kar raha... aur sun yeh flirting ki shuruwat ek doc madam k sath huyi thi jismein tiyathebird auur apne supermod drking ne bhi hissa liya tha... baki yeh aise hi bata diya koi lena dena nahin last wali line se mera @mints

    Intellect is under rapid decline now. After thousands of years people will find it among other excavated artefacts, and they'll discuss causes of it's downfall. Why don't we write a contemporary detail on it? People will find it easy to interpret and will thank us like Kalhana..
