Aggrieved by Paper-2, filed PIL

Hi all,
Under the current rules of 33% qualifying in paper-2, I believe conducting Paper-2 is a futile exercise.
Reason being that top 18000 candidates are highly unlikely to fail in Paper-2. Even if few fail, is it worth the effort to conduct this exam for all 4-5 lakh applicants? Is cost to benefit justified? Would any private organization do it? SBI conducts exam at much larger scale, doesn't bother candidates with any qualifying exam at the prelims stage. And they rather take a shorter duration test at prelims stage.

Why conduct a qualifying exam at the prelims stage? Any fancy report that recommends to make it qualifying ? I guess not.

If this exam is absolutely necessary, why cant it be conducted at the mains stage ? Why bother everyone with a 7 hour exercise?

I feel terribly aggrieved that an apparently random executive decision has been taken and it would hold us all hostage for 5 hours. The candidates would have to wait 3 hours and then write this exam for another 2 hours. Many of us go to these centres with our family members and do come from far off places. They don't go there for a picnic. They bear the inconvenience for their son/daughter when the exam is indispensable. Now it feels like a harassment that could be avoided.

I don't even want to elaborate on the expenditure and paper that can be saved.

I filed an RTI to seek data as to how many top 25000 candidates based on paper 1, in the previous three years failed to score 33% in paper-2. Didn't get the data. didn't appeal in the next month as I was expecting the appellate authority would uphold it.

My younger brother went to high court with a writ petition appearing in person. High court emphasized that I should have exhausted the existing remedies. Allowed me to file an appeal and asked UPSC to dispose it (as per law) within two weeks. Called them today on the 15th day; the reply is as expected though not received the actual letter yet. Basically I am not getting the data.

Now only few days are left before the exam. Again going to court is an elaborate exercise. I don't know if media would be interested in it.

Anyway advice, to get this solved ? other than the advice to study.

I mean poora Paper 2 hi khatam kar deti ,

Firstly, you would have to counter the argument with proof, that it's a futile exercise. Mere assertion of futility may not have much of a stand. Even school children give similar of 3+3 hr exams all the time. Such proof doesn't yet even exis with you, and the current system is yet to be tested. How likely is it that the court would preempt something?

It's an executive action. Courts may or may not like that interfere unless you have proof of some violation of some right of some people.

There is already a committee probing the issue in depth. The court may merely like to wait. Then again, it may not.

Conducting a qualifying exam or not, is the prerogative of the exam conducting authority. You would have to demonstrate that qualifying exams are of no net positive value.

All this seems like an uphill task 2 weeks before prelims.

IMHO, wait 2 weeks and give the exam. Pursue the matter later, if you want.

relied on following evidences:

1. check previous years data and statistics be checked. which was denied in RTI.
2. Conduct of candidates- no one is protesting this year.
3. Conduct of UPSC. They themselves have reduced it's weightage- i.e. not sure about the utility of exam- then why conduct the exam till you are not sure.
4. Common sense. Prima facie.

And hopefully data would be available after this years exam anyway.

Like your initiative, but india is a place where justice is delayed if not denied( applied to common people like us only).
RTI appellate authority can be your next move.
You may want to take help of a lawyer friend after the prelims.
I propose we flood the UPSC with RTI applications asking for the data if they dont give the data to you.
Do tell us what to ask for exactly.

dude read between the lines the paper 2 is gonna be tough
how tough I dont know but certainly not a sitter like last few years
BTW u will surprised in some MBA entrances ( top colleges) exams have cut off marks around 30% I dont know the current trend but I had seen some such papers myself
dont assume that UPSC members are fools
