Can Parliament make changes in A32 (lets say introducing/abolishing Locus Standi criteria) ?
Writ jurisdiction under Art 32 & 226 both form the basic structure of the constitution anyways. So can not be amended.
    SC Chandra case('97).
"Right to constitutional remedies" perains rrom Art32 to Art 35 (may be downloaded from law minn website or if u have pm bakshi then can see there also)
You are talking about " the remedies for enforcement of rights conferred by this Part i.e. 32 (yes it is beyond amendability because it consitutes the basic structure)

    Yes I saw that later.
    Thanks. :)

Are Sir ji. kabhi kabhi hamara tukka lag jata hai. ;)
  • With reference to the Preamble as enshrined in the Indian Constitution, consider the following statements:

‘Equality’ means removing all the differences among the citizens of India.
‘Secular’ means government will not interfere at all in the matters of religion.
‘Republic’ means the Head of the State is an indirectly elected person.

Views on 3rd statement please ?
  • Damm ! Right to sound sleep ye bhi A21 ka part hai :o

1 is only partly correct. It denotes equality before law. The other part is equal protection of laws.

2 is wrong. It means state will give equal treatment to all religions. State itself does not have any religion.

3 is correct. President is the Head of State and s/he is indirectly elected.
Test 1 m kafi wrong ans hai then.

3rd statement is wrong in my opinion...republic mean elected head of state..whether indirect or direct..with reference to preamble it meant that we have an elected head rather than a monarch or his representative..i would have marked 3rd statement as wrong...

Republic should mean elected directly or indirectly no? Because preamble doesn't really specify much.
It perhaps only mean that office is not hereditary and not monarchial and open to citizens.
