Money Laundering: It refers to showing a property or business as being attained through legal means, even though they are the proceeds of crime.
PMLA Prevention of Money Laundering Act (PMLA), 2002 is an act of the Parliament which is meant to prevent money laundering. It also empowers empowered authorities to confiscate and seize properties attained though such means. Features: 1. A rigorous imprisionment of 3 to 7 years is awarded for money-laundering activities. 2. The proceeds of crime are attached provisionally. This means that such property cannot be transferred, converted, disposed or moved. The attachment is to be done after confirmation from Adjudicating Authority. 3. The Adjudicating Authority is established by GoI. It operates on the principles of natural justice and is not bound by Civil Procedure Code. This authority can regulate its procedure of adjudication. 4. The burden of proof for proving innocence and legality of a property lies on the accused. 5. An Appellate Authority appointed by GoI looks into the cases of appeal against the Adjudicating Authority. Further appeals can also be made in High Court and the Supreme Court. 6. Special Courts are also established for faster disposal of the cases. 7. FIU-IND (Financial Intelligence Unit-India) has been designated as the Central Nodal Agency to receive, process, analyze and disseminate information relating to suspect financial transactions. It works under Economic Intelligence Unit (EIU), headed by the Finance Minister. 8. Enforcement Directorate (ED) is a law enforcement and economic intelligence agency which enforces economic laws and fights economic crimes in India. It is also given responsibilities under PMLA. It additionally deals with cases related to FEMA (Foreign Exchange Management Act). ED is a part of Department of Revenue, Ministry of Finance. 9. Under PMLA, banking companies, financial institutions and intermediaries are obliged to verify identity of clients, maintain records and furnish information in prescribed form to FIU-IND.
Born in dismal poverty in Varanasi, Govind achieved 48th rank in 2007’s civil services results. Govind spent childhood in a rented, congested room that he’d to share with three sisters and his parents, with no scope of time and the right setting for study at all. He began to aspire to become an IAS officer when his father and mother, a rickshaw puller and a housewife respectively, sent him to a school in Varanasi.
Even though Govind wanted to go for the civil services through school, IAS always seemed beyond reach, mostly because of poverty. The condition of the family became even worse when his father got a serious leg injury and could no long pull rickshaws. Govind still managed to find room for his dream and became an IAS officer at an age of 23.
