    Marital rape is an exception to rape under IPC, but the Domestic Violence Act comes to the rescue of victims through protection orders or orders to stop violence.

    For instance, a Jodhpur (Rajasthan) court in 2009 directed the husband to not argue with or threaten his wife when drunk. This would have to be followed by him. A violation of this directive would lead to action against the husband on criminal grounds.

    The Supreme Court, in a 20 November 2015 decision, ruled that a wife would be considered an aggrieved person under PWDVA even if she was judicially separated from her husband.

    Significantly, on 6 October, the apex court struck down the words “adult male” from the definition of a respondent, meaning that wives or women in relationships akin to marriages can take legal action against female relatives of their husbands under PWDVA. The court found the law discriminatory and the difference between men and women perpetuating violence “microscopic” in a law aimed at protecting women from such harm.

  • Article on 7th PC report wrt pay inequality in army. (Ensure pay parity for the armed forces)

    The Seventh CPC recommendation has placed a brigadier’s allowances below those of the DIG. This is despite the fact that only 5% of army officers become brigadiers and that too after 26 years of service, whereas more than 90% of IPS officers become DIGs after 14 years. A similar situation crops up when armed forces personnel are compared to Indian Administrative Service officers, who retire at the age of 60, while more than 80% of army officers have to retire at 54. Therefore, not only do most IAS officers enjoy a higher status than armed forces officers from 14-15 years of service onwards, they also benefit greatly in terms of higher salaries from that point on.

    So what went wrong? First, some of the reforms undertaken missed this year’s bus—this report accounts for reforms which had been implemented by 1 June 2016. Indian officials are now expecting a bounty in next year’s report. India also hopes that the insolvency and bankruptcy code will be implemented before the cut-off date for next year’s report but that may be too optimistic. The code’s implementation may take a few more years and India will continue to score poorly on the “resolving insolvency” parameter.

    The World Bank has included a new criterion “postfiling index” under the header “paying taxes”. Used in the report to measure the efficiency of “processes that occur after a firm complies with its regular tax obligations”, the post-filing index is a criterion in which India finds itself fourth from the bottom.

    Modi should not forget that a key aspect of political leadership is expectation management. Two, Modi should despatch a couple of envoys to Georgia and Kazakhstan each. In 2006, Georgia’s rank was 100; this year it ended up at No.16. Kazakhstan (now ranked 35) joined Georgia among the top improvers for the fourth time in the last 12 years. These two countries show that significant strides can be made if the target timeline is reasonable enough.

    Three, these rankings cover only the two cities of Delhi and Mumbai. A ranking of states last year showed the states of Gujarat, Andhra Pradesh, Jharkhand, Chhattisgarh and Madhya Pradesh leading the charts in implementing business reforms. Therefore, India’s overall position may well be better than what this latest report shows.

    Introduction of L1-T1 Methodology for Award of Contracts

    In a clear departure from the past, DPP-2016 has, for the first time, introduced what is widely known as the L1-T1 methodology for selecting the supplier of military goods under the ‘Buy’ and ‘Buy and Make’ schemes. The new methodology, in essence, means that the final bidder would not necessarily be selected on the basis of lowest price quoted by the technically-compliant vendors (the so-called L1 methodology), but by a combination of price and superior technology offered by qualified vendors. The new methodology is intended to buy equipment with Enhanced Performance Parameters (EPP) – a newly introduced feature – which are a notch higher than the Essential Parameters required to be mandatorily met by all the suppliers participating in MoD tenders, in order to stay in competition.
