Can someone please name a few bodies made by executive resolution.
I read somewhere that the RTI does not apply on them. Is it true? If yes, cannot a government defeat the purpose of RTI by making bodies through executive resolutions?
If not, what are some provisions that do not apply to bodies formed through executive resolution but not other bodies?
RTI applies to every body which is funded or substantially funded by public money. This will apply to bodies formed by executive resolution.
Executive resolution is nothing but the Cabinet passing an order. This is opposite of statutory bodies which are created by passing a law - like SEBI Act forms SEBI.
In executive resolution, bodies are created by the cabinet resolution or even by the order of a ministry, PMO etc.
Planning commission was one such body which was created by Nehru. Modi 's government passed an order to dismantle it. It did not require any approval from the Parliament.
