NRGBA constitutional base

NGRBA get its constitutional base from Environment (Protection)Act, 1986 not from river board act 1956. Why is it so, What are the obstruction which leads not even a one setup of river board. Though constitution says to do so.

    NGRBA was constituted to

    Clean up Ganga and make it potable for human consumption which is under the purview of EPA, 1986. Also, the monitoring would have to be done by CPCB and SPCBs which are governed by EPA, 1986 and WPA, 1974.

    While, River Board Act talks more about managing water of rivers in an amicable way between states based on Basin level conservation and catchment.

    The ambit of the aim decides the scope. Prevention of Pollution was the reason for NGRBA to be constituted and hence EPA, 1986, had it been for better water management and increasing the irrigation capacity for which NGRBA was established, it would have come under RBA, 1956.

  • Coming to your other question, why not even one River Board,

    The biggest reason is politics and lack of co-operation among states and Water being a State subject, Centre's hands are tied as well.

    Cauvery - TN, Karnataka fight so hard - it gives political mileage
    Krishna - 2 tribunals - Telangana wants newer tribunal to reconsider the division of water allocated to erstwhile Undivided AP.

    Till politics drive each and every decision, there can be no co-operation and regional polity needs issues to simmer and live on.

  • shukriya thor ji, Though your reply clear the picture. Is it mere politics or some thing else which obstructs setup of river board. I doubt it, because functions of the Board are advisory and not adjudicatory.

    I am from AP and have been in Kar,TN as well. Have seen how tempers boil when we talk of rivers. It is seen like the other state and its people are robbing them of their livelihood. You need to see how the politics run. They are indeed a huge hindrance.

    Also, whose recommendations aren't advisory - NHRC, NCM, NCW, NCST, NCSC etc. all of these bodies - Even PAC, Estimates Committee : their recommendations are advisory but aren't they being constituted on a timely basis.

    Regional hindrance and water being a state subject is the huge impediment.
