[Doubt] [Polity] Parliament

Hi,

After going through Laxmikanth's Parliament chapter, I hv a few doubts

1. Adjournment motion cannot be passed in Rajya Sabha. Why?
2. What is point of order?
3. What are different types of motion? I'm unable to understand that topic because the language seems tough with no examples.

    Try googling your doubts, there is literally no legitimate doubt that cannot be cleared by searching the internet.

    1. Since RS members are not directly elected by the people and the adjournment motion is a sort of censure of the government. LS creates the government, hence only it can censure it.
    2. A point of order relates to the interpretation or enforcement of rules which regulate the business of the House and raises a question which is within the cognizance of the Speaker. Speaker may permit a member to raise a point of order if it relates to maintenance of order in, or arrangement of business before, the House.

    Constitution has no mention of such a case as far as I know .When Pres's office falls vacant due to his death, resignation , removal or otherwise then an election to the office has to be held within 6 months from the date of vacancy.Till then VP acts as a President.

    Impeachment per se is meant for removal of President .An acting President is also a President so theoretically he should also be impeached from his office but as I said Constitution has no mention of this type of condition as far as I know .

    A resolution of RS passed by an absolute majority is needed for removal of VP. Constitution explicitly mentions that the above method is for removal of VP and not President.

    So my guess would be that an impeachment should work in this case too .

  • At time of acting as the President , VP is not to work as chairperson of RajyaSabha . He is not VP at that time
    He has to be impeached

    Impeachment Bro.. When Vice president stands by as the president then even he'll take oath of office just like the presidents, so he'll be a de facto president whose powers in no differs from that of a regular president. So he has to be impeached.

    Impeachment is such a major issue that by the time a consensus has been reached on going ahead with it, the president's office will be reoccupied by a 1st order president. Then just vote VP out with absolute majority in RS.
    I don't like to reply to idiots and if you think I am referring to you, you are probably correct.
